Structure at a Glance

Two hourly tracks. Track A covers guardianship and day-to-day care. Track B covers financial and legal fiduciary work, including durable power of attorney, executor/personal representative, trustee, and other professional fiduciary services.

When a Governing Document Sets the Fee

In many cases, the trust agreement, will, durable power of attorney, or other governing legal instrument already specifies the fiduciary’s compensation. When it does, that document controls. Florida law follows this same approach for trusts: under Fla. Stat. § 736.0708(1), a trustee’s compensation is governed by the trust’s own terms, and only defaults to what is reasonable under the circumstances when the trust is silent on the point. AgedCare Guardian complies with a governing document’s terms rather than applying the schedule below. Where a governing document is silent, AgedCare applies the hourly rates below and, for personal representative work, the statutory percentage schedule described later on this page. Any retainer required is set out in the engagement agreement rather than published here.

Services and Rates

Track A: Guardianship & Care Coordination

Billed at $75.00-$100.00 per hour for the Professional Guardian.

Guardianship of the person and/or property covers care planning, coordination of medical and residential services, asset management, and required court reporting for an incapacitated ward.

Track B: Fiduciary, Estate & Trust Administration

Billed at $250.00 per hour for the Senior Fiduciary Officer and $125.00 per hour for Fiduciary Administrative Staff, unless the percentage-based fee below applies.

Durable Power of Attorney

Acting as agent: bill payment, account management, benefits coordination, and other authorized actions on the principal’s behalf.

Executor / Personal Representative

Estate administration: asset collection, creditor claims, tax filings, distributions, and court accountings. Retainer terms are set out in the engagement agreement, and percentage-fee eligibility is described later on this page.

Trustee

Trust administration: investment oversight, distributions, tax filings, and accountings. Retainer terms are set out in the engagement agreement. This work is billed hourly only, since Florida sets no percentage schedule for trustees.

Professional Fiduciary Services (General)

Other fiduciary roles, such as successor fiduciary or trust protector appointments, or consulting requested by a family, attorney, or the court.

Institutional Referrals

The Institutional Placement Guardianship Program covers guardianship cases referred by a hospital, facility, or institution. It is separate from the Community Indigent Guardianship Program, which provides free guardianship services directly to qualifying individuals.

It is billed against a retainer set out in the referral agreement, applied to Guardian time, plus customary attorney’s fees.

Estate and Trust Size

AgedCare Guardian serves estates and trusts of every size and does not decline a case for being modest in value. Size may affect the retainer set out in the engagement agreement, but not the hourly rate or the option to elect the percentage-based fee below for personal representative engagements, which are the same regardless of size.

Outside Contractors and Providers

Some engagements need outside professionals AgedCare Guardian does not employ directly, such as appraisers, accountants, real estate agents or brokers, surveyors, or investment managers. These are reimbursable expenses of the estate, trust, or ward, not part of AgedCare’s own fee or retainer. They are passed through at cost and paid from the estate, trust, or ward’s assets, subject to any required court approval.

Personal Representative Fee: Statutory Percentage Schedule

When a will or other governing document does not specify personal representative compensation, Florida law (Fla. Stat. § 733.617) provides the percentage-based commission schedule below, which courts treat as presumptively reasonable, calculated on the full estate value. AgedCare Guardian may also bill personal representative work at the Track B hourly rate instead, by agreement.

All fees, retainers, and third-party costs shown are estimates. Actual amounts depend on case complexity and, where required by Florida law (§§ 744.108, 733.617, 736.0708), are subject to court approval.
